Terms of Service — iCameraPlus

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and iCameraPlus (see Legal Notice for the provider identity) governing your use of the iCameraPlus apps (iOS, Android), the website icameraplus.com and related services (together, the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

iCameraPlus lets you use a device you own as a security camera: it records video (and, optionally, audio) and can upload recordings to your private cloud archive and stream live at your request. Recording is not covert — the app shows a live preview, a recording indicator and a persistent notification while recording. It is a project to repurpose (recycle) a spare phone you already own, for use on your own property; it is not a certified professional security system, and its recordings may not meet standards for security or evidentiary use.

3. Eligibility & account

You must be at least 18 years old (or the age of majority where you live) and legally able to enter into contracts. You are responsible for your login credentials and for all activity under your account. Provide accurate information and keep it current.

4. Subscriptions, billing & cancellation

The Service offers a free trial followed by an auto-renewing subscription in tiers (2/4/6/8 cameras). Purchases are processed by Apple App Store or Google Play under their terms; we do not receive your card details. The subscription renews automatically for the same period unless you cancel at least 24 hours before renewal via your App Store / Play Store account. Prices, term and included tier are shown before purchase. EU/EEA consumers have a 14-day right of withdrawal for distance contracts; because the Service starts immediately, by starting to use it you request immediate performance and acknowledge that the withdrawal right is lost once the Service is fully performed. Cancellation and refunds are handled through Apple/Google.

5. YOUR LEGAL RESPONSIBILITY FOR RECORDING

You are solely responsible for using the Service lawfully. Laws on recording people, audio and video vary by country and region and can be strict. In particular:
  • Audio recording of other people's conversations without the consent of everyone present is a criminal offence in many places (e.g. all-party-consent US states such as California and Illinois; Germany §201 StGB; France Art. 226-1). Keep audio off unless you have the necessary consent.
  • Do not place a camera in bathrooms, toilets, changing rooms, bedrooms or any place where a person has a reasonable expectation of privacy.
  • If you record employees, domestic staff (e.g. a nanny) or visitors, you must inform them and comply with local employment and data-protection law; continuous covert surveillance of workers is prohibited in many countries.
  • Where the camera captures areas beyond your own private property, you may become a "data controller" under the GDPR/UK GDPR with your own transparency and lawful-basis duties.
You agree to obtain all consents and provide all notices required by law, and you indemnify us against claims arising from your unlawful use.

6. Acceptable use

You may not use the Service to: (a) record any person unlawfully or without a required consent; (b) harass, stalk, spy on or endanger anyone; (c) infringe others' privacy or rights; (d) break any law; or (e) interfere with, reverse-engineer or misuse the Service. We may suspend or terminate accounts that violate these Terms.

7. Your content

You keep all rights to your recordings ("User Content"). You grant us a limited licence to store, transmit and process User Content only to provide the Service to you (e.g. upload, storage, live streaming, deletion). We do not sell your User Content or use it for advertising. See the Privacy Policy for details, including who can access data and our retention/deletion practices.

8. Availability & no warranty

The Service is provided "as is" without warranties of any kind. Continuous 24/7 recording depends on your device, power and network, and on platform limits — in particular, iOS does not permit camera recording in the background, so on iOS the app records only while in the foreground (Guided Access / Protected Mode is recommended). We do not guarantee uninterrupted recording, that recordings will be preserved, or that the Service will be error-free. Storage quotas apply and the oldest recordings may be deleted automatically when the quota is reached.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for lost or unavailable recordings, missed events, or damage arising from your use or inability to use the Service. Nothing in these Terms limits liability that cannot be limited by law (including mandatory consumer rights).

10. Termination

You may stop using the Service and delete your account at any time from within the app (Settings → Delete account). We may suspend or end the Service or your account for breach of these Terms or where required by law. On deletion your account and stored recordings are removed as described in the Privacy Policy.

11. Changes

We may update these Terms; we will notify you of material changes by email or in the app. Continued use after changes take effect means you accept the updated Terms.

12. Governing law & contact

These Terms are governed by the law of the provider's place of establishment (see Legal Notice), without prejudice to mandatory consumer-protection rules of your country of residence. Contact: icamatrixsys@gmail.com.
